Terms of Service.

If you do not agree with any provision of these Terms of Service, you must immediately cease all access to our website and remove all A11yGo Toolbar script embeds from your digital properties.

Arbitration Notice: These terms include mandatory individual arbitration and class action waiver provisions set forth in Section 12.

• "Service" / "Platform": Refers collectively to the A11yGo Toolbar JavaScript application, CSS accommodations, Cloud dashboard, automated scanning engines, APIs, and associated documentation.
• "Customer" / "User" / "You": Refers to any individual, business, financial institution, governmental agency, or entity that subscribes to, embeds, or interacts with the Service.
• "License": The revocable, non-exclusive, non-transferable right granted by A11yGo to embed and execute the Toolbar on registered domains.
• "Subscription": The paid or promotional tier providing access to premium features, domain activations, and technical maintenance.

3.1 Eligibility

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) and possess the legal authority to bind your organization to these Terms.

3.2 Account Credentials & Responsibilities

You are solely responsible for maintaining the confidentiality of your administrative portal credentials, API keys, and license tokens. You agree to notify A11yGo immediately at [email protected] upon discovering any unauthorized account activity.

4.1 Grant of License

Subject to compliance with these Terms and payment of applicable subscription fees, A11yGo grants you a limited, revocable, non-exclusive, non-transferable license to embed and execute the A11yGo Toolbar on domains explicitly authorized under your active subscription plan.

4.2 Prohibited Conduct & Restrictions

You shall not, directly or indirectly:

• Decompile, disassemble, reverse engineer, or attempt to derive the source code of the A11yGo core engine or proprietary scripts.
• Modify, adapt, translate, or create derivative works of the Toolbar software.
• Remove, alter, or obscure any copyright, trademark, or proprietary notices embedded within the software.
• Resell, sublicense, lease, or distribute the license key to unauthorized third parties or unwhitelisted domains.
• Bypass domain verification mechanisms, license validation checks, or security rate limits.

5.1 30-Day Free Demo Evaluation

A11yGo provides a complimentary 30-Day Free Trial (No Credit Card Required) enabling organizations to evaluate all features risk-free prior to commercial commitment. Upon trial expiration, the toolbar automatically operates in Free Mode (core accommodations) until a paid plan is selected.

5.2 Commercial Invoicing & Taxes

Commercial subscriptions are billed on an annual basis via Proforma Invoices with payment options including UPI, NetBanking, Credit/Debit cards, and NEFT/RTGS wire transfers. All fees are exclusive of applicable taxes (including GST), which will be itemized on the final tax invoice.

5.3 Refund Policy

Because A11yGo provides an unconditional 30-Day Full Feature Trial, payments made for fulfilled annual commercial subscriptions are non-refundable once the license key has been activated, except where mandated by applicable consumer protection laws.

You agree to use the Service in compliance with all applicable local, national, and international laws, including data privacy and cyber regulations. You agree not to use the Service to:

• Distribute malicious software, spyware, viruses, or harmful payload code.
• Interfere with or disrupt server integrity, network security, or CDN delivery nodes.
• Impersonate any individual, corporate entity, or official authority.
• Deploy the Toolbar on digital properties promoting hate speech, unlawful discrimination, or fraudulent financial schemes.

All intellectual property rights, trademarks, patents, software algorithms, UI designs, and documentation in A11yGo Toolbar are and remain the exclusive property of A11yGo and its licensors.

Nothing in these Terms transfers any intellectual property rights to you other than the limited, revocable license granted in Section 4.

We reserve the right to immediately suspend or terminate your account and revoke license keys without prior notice if:

• You commit a material breach of these Terms or engage in unauthorized license reproduction.
• You fail to fulfill invoice dues after appropriate notice.
• Required by regulatory directive or court order.

Upon termination, you must remove all script tags from your web portals. Provisions regarding Intellectual Property, Warranties, Liability, and Arbitration survive termination.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by applicable law, in no event shall A11yGo, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising out of or related to your use of the Service.

Our aggregate liability for all claims related to the Service shall not exceed the total fees paid by you to A11yGo in the twelve (12) months preceding the event giving rise to liability.

You agree to defend, indemnify, and hold harmless A11yGo, its affiliates, and officers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms, unauthorized modification of the software, or infringement of third-party rights.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

12.2 Arbitration & Jurisdiction

Any dispute arising out of or relating to these Terms shall be resolved amicably through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be in Bangalore, India, and proceedings shall be conducted in English.

• Entire Agreement: These Terms constitute the entire agreement between you and A11yGo regarding the Service, superseding all prior oral or written agreements.
• Severability: If any provision is deemed unlawful or unenforceable, that provision shall be severed without affecting the validity of the remaining terms.
• Updates to Terms: We may update these Terms periodically. Continued use of the Service following published modifications indicates your agreement to the revised terms.
